Acceptance of Terms

Welcome to GhostKit. These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "You", "Customer") and GhostKit ("Company", "We", "Us", "Our") governing your access to and use of the GhostKit software products, website (getghostkit.com), applications, and related services (collectively, the "Software" or "Services").

By downloading, installing, purchasing, accessing, or using any GhostKit Software, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not download, install, or use the Software and must immediately discontinue any use thereof.

You represent and warrant that you are at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater, and have the legal capacity to enter into this Agreement.

Definitions

For the purposes of this Agreement, the following terms shall have the meanings ascribed to them below:

• "Software" refers to all GhostKit products, including but not limited to GhostKit Location, GhostKit Analyzer Pro, GhostKit Bundle, and any updates, patches, or modifications thereto.
• "License" refers to the right granted to the User to use the Software under the terms specified herein.
• "License Key" refers to the unique alphanumeric code provided to the User upon purchase that activates the Software.
• "Device" refers to any Android-powered smartphone, tablet, or other electronic device on which the Software is installed.
• "Subscription" refers to a time-limited License (monthly, quarterly, or annual) that requires periodic payment for continued access.
• "Lifetime License" refers to a perpetual License valid for the current major version of the Software.

License Grant

Subject to your compliance with these Terms and payment of applicable fees, GhostKit grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Software on the number of Devices permitted by your License tier, solely for your personal use.

3.1 License Scope

• Each License Key is valid for activation on a limited number of Devices as specified in your purchase plan.
• Subscription Licenses are valid for the duration of the paid subscription period only.
• Lifetime Licenses are valid for the current major version of the Software and do not guarantee access to future major version releases.
• All Licenses are personal to the purchaser and may not be sold, transferred, shared, sublicensed, or otherwise distributed to any third party.

3.2 No Ownership Transfer

The License granted herein does not constitute a sale of the Software. GhostKit retains all right, title, and interest in and to the Software, including all intellectual property rights therein. You acquire only the right to use the Software in accordance with these Terms.

Use Restrictions

You agree that you shall NOT:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software;
• Modify, adapt, translate, or create derivative works based on the Software;
• Copy, reproduce, distribute, publicly display, or publicly perform the Software;
• Rent, lease, lend, sell, sublicense, or otherwise transfer the Software or any License Key to any third party;
• Remove, alter, or obscure any proprietary notices, labels, or marks on the Software;
• Use the Software to develop a competing product or service;
• Circumvent, disable, or interfere with any security features, license verification mechanisms, or usage limitations of the Software;
• Share, publish, or distribute License Keys in any public or private forum;
• Use automated systems, bots, or scripts to access or interact with GhostKit services in an unauthorized manner.

User Responsibility & Assumption of Risk

5.1 Sole Responsibility of the User

GhostKit develops and distributes software tools designed for device management, location management, privacy protection, testing, and development purposes. The Software is a tool — nothing more, nothing less. Like any tool, it can be used for a wide range of purposes. The decision of how, when, where, and why to use the Software rests entirely with the User.

GhostKit does not control, direct, supervise, endorse, or assume responsibility for how Users employ the Software after purchase and installation. The User is solely responsible for ensuring that their use of the Software complies with all applicable local, state, national, and international laws, regulations, rules, ordinances, and guidelines of their jurisdiction.

5.2 Analogy of Responsibility

The relationship between GhostKit and its Users is analogous to that between a tool manufacturer and the end-user of that tool. A knife manufacturer produces cutting tools for legitimate purposes such as cooking, crafting, and utility. If a purchaser misuses that tool, the manufacturer bears no legal or moral responsibility for the misuse. Similarly:

• An automobile manufacturer is not liable for traffic violations committed by drivers;
• A firearm manufacturer is not liable for the unlawful discharge of their product by the purchaser;
• A computer manufacturer is not liable for illegal activities conducted on their hardware;
• A VPN provider is not liable for the activities of users routing traffic through their servers.

In the same manner, GhostKit is a software tool provider. We provide technology. The responsibility for the application of that technology lies exclusively with the User.

5.3 Lawful Use Obligation

By using the Software, you represent and warrant that:

• You will use the Software only for lawful purposes and in compliance with all applicable laws and regulations in your jurisdiction;
• You will not use the Software to violate the terms of service of any third-party application, platform, or service;
• You will not use the Software to commit fraud, deception, harassment, stalking, or any form of illegal activity;
• You will not use the Software to gain unfair advantages in competitive environments where such use is prohibited;
• You understand that certain uses of location spoofing, device identity modification, or similar functions may be prohibited in your jurisdiction, and you accept full responsibility for determining the legality of your specific use case;
• You have independently assessed the risks associated with using the Software and voluntarily assume all such risks.

5.4 Assumption of Risk

You expressly acknowledge and agree that your use of the Software is at your sole risk. You understand that using the Software may result in consequences including but not limited to:

• Suspension or termination of your accounts on third-party platforms;
• Loss of data, virtual assets, or digital property on third-party platforms;
• Device instability, malfunction, or voiding of device warranty;
• Legal consequences in jurisdictions where specific uses of the Software may be restricted or prohibited;
• Any other direct, indirect, or consequential outcomes resulting from your use of the Software.

5.5 No Encouragement of Illegal Activity

Nothing in GhostKit's marketing materials, documentation, website content, or these Terms shall be construed as encouraging, promoting, or endorsing the use of the Software for any unlawful purpose. Any references to specific use cases (including gaming, privacy, testing, or multi-account management) are provided as examples of potential legitimate applications and do not constitute legal advice regarding the permissibility of such uses in your jurisdiction.

Accounts & Security

To access certain features of the Software, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete registration information;
• Maintain and promptly update your registration information;
• Maintain the confidentiality of your account credentials and License Keys;
• Accept responsibility for all activities that occur under your account;
• Immediately notify GhostKit of any unauthorized use of your account.

GhostKit reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable.

Payment & Billing

7.1 Pricing

All prices are displayed in United States Dollars (USD) unless otherwise specified. Prices are subject to change at any time without prior notice, provided that price changes shall not affect existing active Subscriptions until the next renewal period.

7.2 Subscription Billing

Subscription plans are billed in advance on a recurring basis (monthly, quarterly, or annually, depending on the plan selected). Your Subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. You authorize us to charge the applicable Subscription fee to your selected payment method at the beginning of each billing period.

7.3 Taxes

All fees are exclusive of applicable taxes. You are responsible for paying all taxes associated with your purchase, except for taxes based on GhostKit's net income.

7.4 Failed Payments

If a payment fails, your access to the Software may be suspended until the payment issue is resolved. GhostKit is not responsible for any loss of access resulting from failed payments.

Refund Policy

8.1 Eligible Refund Scenarios

You are entitled to a full refund or replacement under the following circumstances:

• Defective Software: The Software contains a critical bug, error, or defect that prevents it from functioning as described in its product documentation, and GhostKit is unable to resolve the issue within a reasonable timeframe (14 business days).
• Material Misrepresentation: The Software materially differs from the features and functionality described on the GhostKit website or in official product documentation at the time of purchase.
• Non-Delivery: You did not receive the Software, License Key, or access credentials after a completed payment, and GhostKit is unable to resolve the delivery issue.
• Duplicate Purchase: You were charged multiple times for the same product due to a billing error.
• Incompatibility (with conditions): The Software is fundamentally incompatible with your Device despite meeting the minimum system requirements published on the GhostKit website, and GhostKit is unable to resolve the compatibility issue.

8.2 Refund Request Procedure

To request a refund, you must:

1. Contact GhostKit support at [email protected] within 14 days of purchase;
2. Provide your order number, email address used for purchase, and a detailed description of the issue;
3. Provide evidence of the defect, error, or issue (screenshots, error logs, device information);
4. Allow GhostKit a reasonable opportunity (up to 14 business days) to diagnose and resolve the issue before a refund is processed.

Refunds will be processed to the original payment method within 5-10 business days after approval.

8.3 Non-Refundable Scenarios

Refunds will NOT be granted in the following circumstances:

• Change of mind, buyer's remorse, or deciding you no longer need the Software;
• Failure to read the product description, system requirements, or these Terms before purchase;
• Issues caused by third-party software, rooting/jailbreaking, custom ROMs, or modifications not supported by GhostKit;
• Account suspension or termination on third-party platforms (games, social media, etc.) resulting from your use of the Software;
• Legal consequences arising from your use of the Software;
• Loss of virtual assets, game progress, accounts, or any other intangible property on third-party platforms;
• Software functioning as described but not meeting your personal expectations;
• Refund requests made more than 14 days after the original purchase date;
• Violation of these Terms of Service by the User;
• Lifetime License purchases after 30 days of use.

8.4 Partial Refunds

At GhostKit's sole discretion, partial refunds or account credits may be offered in cases that do not fully meet the criteria for a complete refund but where the User has experienced a genuine issue.

8.5 Subscription Cancellation

You may cancel your Subscription at any time. Upon cancellation, you will retain access to the Software until the end of your current billing period. No refunds will be issued for partial billing periods. Cancellation does not retroactively refund previous billing cycles.

Limitation of Liability

Indemnification

You agree to defend, indemnify, and hold harmless GhostKit and its officers, directors, employees, agents, partners, suppliers, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Software;
• Your violation of any term of this Agreement;
• Your violation of any applicable law, regulation, or third-party right, including without limitation any intellectual property, privacy, or consumer protection right;
• Any claim that your use of the Software caused damage to a third party;
• Any dispute between you and a third party arising from your use of the Software;
• Any consequences resulting from your use of the Software on third-party platforms, including account suspensions, bans, or legal proceedings.

This indemnification obligation will survive the termination of this Agreement and your use of the Software.

Intellectual Property

The Software, including but not limited to its source code, object code, design, architecture, algorithms, user interface, graphics, icons, documentation, and all related intellectual property, is and shall remain the exclusive property of GhostKit. The Software is protected by copyright, trade secret, and other intellectual property laws.

The GhostKit name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of GhostKit. You may not use such marks without the prior written permission of GhostKit.

All rights not expressly granted to you under this Agreement are reserved by GhostKit.

Termination

13.1 Termination by User

You may terminate this Agreement at any time by ceasing to use the Software, uninstalling it from all Devices, and requesting account deletion by contacting [email protected].

13.2 Termination by GhostKit

GhostKit may terminate or suspend your License and access to the Software immediately, without prior notice or liability, for any reason, including without limitation if you breach any provision of these Terms. Upon termination:

• Your License to use the Software is immediately revoked;
• You must cease all use of the Software and delete all copies from your Devices;
• Your account and associated data may be deleted;
• No refund will be issued for any prepaid and unused Subscription period if termination was due to your breach of these Terms.

13.3 Survival

The following sections shall survive termination of this Agreement: User Responsibility (Section 5), Warranty Disclaimer (Section 9), Limitation of Liability (Section 10), Indemnification (Section 11), Intellectual Property (Section 12), Dispute Resolution (Section 15), and any other provision which by its nature should survive.

Privacy Policy

14.1 Information We Collect

GhostKit collects the following categories of information:

• Account Information: Email address, username, and encrypted password when you create an account.
• Payment Information: Transaction records and billing details. Note: Full payment card details are processed by our third-party payment processors and are never stored on GhostKit servers.
• Device Information: Device model, operating system version, unique device identifiers, and app version for license verification and technical support purposes.
• Usage Data: Software activation records, feature usage statistics, and error/crash reports to improve the Software.
• Communication Data: Information you provide when contacting our support team.

14.2 How We Use Your Information

We use the collected information for the following purposes:

• To provide, maintain, and improve the Software;
• To process transactions and manage Licenses;
• To verify License Keys and prevent unauthorized use;
• To provide customer support and respond to inquiries;
• To send important notices, updates, and security alerts;
• To detect, investigate, and prevent fraudulent or unauthorized activity;
• To comply with legal obligations.

14.3 Data Sharing

GhostKit does not sell, trade, or rent your personal information to third parties. We may share your information only in the following limited circumstances:

• Payment Processors: With our payment processing partners to facilitate transactions;
• Legal Requirements: When required by law, subpoena, court order, or governmental regulation;
• Protection of Rights: To protect the rights, property, or safety of GhostKit, our users, or the public;
• Business Transfers: In connection with a merger, acquisition, or sale of all or a portion of our assets.

14.4 Data Security

We implement industry-standard security measures to protect your personal information, including encryption of passwords (bcrypt hashing), HTTPS/TLS encryption for data in transit, and access controls on our servers. However, no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.

14.5 Data Retention

We retain your personal information for as long as your account is active or as needed to provide you the Software and Services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

14.6 Your Rights

Depending on your jurisdiction, you may have the following rights regarding your personal data:

• The right to access, correct, or delete your personal information;
• The right to data portability;
• The right to withdraw consent;
• The right to object to certain types of processing;
• The right to file a complaint with a data protection authority.

14.7 Cookies

Our website uses essential cookies required for the functionality of the site (session management, authentication). We do not use tracking cookies or third-party advertising cookies.

Dispute Resolution

15.1 Informal Resolution

Before filing any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting GhostKit at [email protected]. We will attempt to resolve the dispute informally within 30 days. If the dispute is not resolved within this period, either party may proceed with formal dispute resolution.

15.2 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any legal proceedings arising out of or relating to this Agreement shall be brought exclusively in the courts of Tekirdağ, Turkey.

15.3 Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND GHOSTKIT AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration against GhostKit.

15.4 Limitation Period

Any claim arising out of or relating to this Agreement must be brought within one (1) year after the cause of action accrues. Claims brought after this period are permanently barred.

Changes to Terms

GhostKit reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, by posting the updated Terms on our website and/or notifying you via email.

Your continued use of the Software after any changes to these Terms constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Software.

It is your responsibility to review these Terms periodically for changes. The "Last Updated" date at the top of this page indicates when these Terms were last revised.

General Provisions

17.1 Entire Agreement

This Agreement constitutes the entire agreement between you and GhostKit regarding the Software and supersedes all prior or contemporaneous understandings, agreements, negotiations, representations, and warranties, both written and oral.

17.2 Severability

If any provision of this Agreement is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.

17.3 Waiver

The failure of GhostKit to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. Any waiver of any provision of this Agreement will be effective only if in writing and signed by GhostKit.

17.4 Assignment

You may not assign or transfer this Agreement or any rights or obligations hereunder without the prior written consent of GhostKit. GhostKit may freely assign this Agreement without restriction.

17.5 Force Majeure

GhostKit shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, epidemics, power outages, internet failures, government actions, or natural disasters.
